NOTICE OF CATEGORICAL EXCLUSION
NOTICE TO ALL INTERESTED PERSONS

The Department of Environmental Protection has issued a categorical exclusion in compliance with Section C of the State of Maine's Clean Water State Revolving Fund rules, Chapter 595, on behalf of the City of Bangor to exempt a proposed action from the substantive environmental review requirements

The proposed action is to replace the poorly functioning Combined Sewer Overflow (CSO) regulator structure for the Davis Brook overflow storage conduit with a reconfigured structure, replace a portion of the existing stone drainageway with reinforced concrete pipe, and replace the piping from the regulator to the storage conduit. A Shoreland Zoning Permit will be obtained since a small portion of the project will occur within the City's 250-foot setback from the Penobscot River.

The proposed project will occur within the City's owned easement. Also, per the City's Combined Sewer Overflow (CSO) Master Plan, the project will help prevent future CSO activity by replacing a poorly functioning regulator structure and associated piping.

A review of the proposed action by the DEP has indicated that it meets the criteria for a Categorical Exclusion. Specifically, the proposed action is directed solely the functional replacement of the regulator and adjacent piping. This exclusion may be revoked at any time if any of the criteria used for its issuance are violated. 

Further records in regard to the project are on file and are available for public review at the City Office, 73 Harlow Street, Bangor, Maine and the offices of the Department of Environmental Protection, 25 Tyson Drive, Augusta, Maine. Comments relative to this decision may be submitted to the town or DEP within fifteen days.
